Event Terms and Conditions
Last Updated: October 12, 2026
These Event Terms and Conditions (“Event Terms”) apply when You register for, purchase a ticket to, or attend any conference, workshop, summit, webinar, meetup, or other event hosted or co-hosted by Marketing Artificial Intelligence Institute LLC d/b/a SmarterX (“SmarterX”, “we,” “us,” or “our”), whether in person, virtual, or hybrid, including MAICON (each, an “Event”). These Event Terms are part of, and incorporated into, our Terms of Use, available at https://smarterx.ai/terms-of-use (the “Terms of Use”), and purchases of tickets are also subject to our Terms of Sale and Refund Policy, available at https://www.smarterx.ai/terms-of-sale. If these Event Terms conflict with those documents regarding an Event, these Event Terms control. Our Privacy Policy, available at https://smarterx.ai/privacy-policy, explains how we handle attendee information.
BY REGISTERING FOR OR ATTENDING AN EVENT, YOU AGREE TO THESE EVENT TERMS, INCLUDING THE PHOTOGRAPHY AND RECORDING TERMS IN SECTION 6, THE ASSUMPTION OF RISK IN SECTION 9, AND THE BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER IN SECTION 20 OF THE TERMS OF USE.
1. Registration and Eligibility
You must provide complete and accurate registration information. Registration is personal to the named attendee. You must be at least 18 years old to register unless an Event is designated as open to minors, in which case attendees under 18 must be registered and accompanied by a parent or legal guardian who agrees to these Event Terms on their behalf. We may decline or cancel any registration at our discretion including registrations from competitors or registrations that appear fraudulent and will refund any amount paid for a registration we cancel for reasons other than Your breach of these Event Terms.
2. Tickets, Pricing, and Payment
Ticket types, prices, what each ticket includes (for example, sessions, meals, recordings or networking functions), and any applicable deadlines are described on the Event page. Early-bird, group, or promotional pricing is subject to the conditions stated in the offer and are not applicable for future orders. Tickets are not valid for resale, and tickets obtained through unauthorized resellers may be canceled without refund. Payment is due in full at registration unless otherwise stated or as otherwise communicated to You by us.
3. Cancellations, Transfers, and Refunds by Attendees
Cancellation Policy. All cancellation requests must be submitted in writing to support@smarterx.ai.
75 or more days before the event: Attendees may receive a 50% refund of their registration fee or transfer 100% of the registration fee toward another SmarterX program currently open for registration.
Fewer than 75 days before the event: Registration fees are nonrefundable. However, attendees may substitute another person in their place or transfer 100% of their registration fee toward another SmarterX program currently open for registration, provided the request is completed before the event begins.
Substitutions. Attendee substitutions are permitted at no additional charge before the event begins. All substitution requests must be submitted using the designated substitution form.
Registration Credits and Transfers. Registration fees may only be transferred to existing SmarterX programs that are open for registration at the time of the request. Credits cannot be held for future events that are not yet available for purchase. Any remaining balance that is not applied before the original event begins will be forfeited.
Additional Conditions. Event registrations cannot be rolled over to a future edition of the same event unless that edition is currently open for registration and the transfer is completed in accordance with this policy.
4. Changes, Postponement, and Cancellation by Us
Event programs, speakers, schedules, formats, and venues are subject to change. We will try to notify registered attendees of material changes. We are not required to refund registrations because a particular speaker or session is replaced or removed.
If we cancel an Event, in our discretion and dependent on circumstances, we will offer either a refund or a credit or a combination of both items for a future event. If we postpone an Event or change it from in-person to virtual, You may use Your registration for the rescheduled or virtual Event or receive a credit. If an Event is canceled, postponed, or modified due to circumstances beyond our reasonable control (such as severe weather, natural disasters, public-health emergencies, government orders, venue unavailability, labor disputes, or security threats), we will offer a credit toward a future Event. We are not responsible for travel, lodging, or other costs You incur, and we recommend travel insurance.
5. Attendee Conduct
All attendees, speakers, sponsors, and exhibitors must follow our ethical rules and guidelines, including any codes of conduct, which may be provided to you at any time, venue rules, and applicable law. We do not tolerate harassment, discrimination, threats, disruptive behavior, or unauthorized solicitation. We may remove any person from an Event, or revoke virtual access, without refund if we believe that person has violated these Event Terms or the Code of Conduct or poses a safety risk. Attendees who consume alcohol at Event functions must be of legal drinking age and do so responsibly.
6. Photography, Video, and Recording
Our recordings. We and our authorized photographers, videographers, and media partners may photograph, film, livestream, and record Events, including attendees, audience questions, and virtual chat and participation. By attending, You grant us and our affiliates a perpetual, worldwide, royalty-free license to use Your name, image, likeness, voice, and statements as captured in those materials, in any media, to document, archive, distribute, and promote the Event and future events, our courses, and our products and services, without compensation or further approval. We will not use Your image in a way that states or implies Your personal endorsement of a product without Your separate consent.
Your recordings. Unless we state otherwise, You may take personal photos, but You may not record audio or video of sessions, or livestream or redistribute session content, without our prior written consent. Session content, presentations, and materials are owned by us or the speakers and are provided for Your personal use only.
7. Attendee Information, Sponsors, and Exhibitors
We collect and use Your registration and attendance information as described in our Privacy Policy. Event sponsors and exhibitors support our Events. By registering, You acknowledge that we share Your name, job title, company, and business contact information with sponsors and exhibitors and that if You allow a sponsor or exhibitor to scan Your badge or You attend a sponsored session, that sponsor will receive Your badge information, and that they may contact You about their products and services under their own privacy policies. You may opt out of pre-Event and post-Event attendee-list sharing by emailing support@smarterx.ai or otherwise as designated by us. Depending on where You live, You may also have the right to opt out of the “sale” or “sharing” of personal information as described in our Privacy Policy.
Event apps and networking tools may display Your profile to other attendees. You can control Your profile visibility in the app settings.
8. Accessibility and Accommodations
We want our Events to be accessible to everyone. If You need an accommodation, including dietary, mobility, or communication accommodations, please contact support@smarterx.ai at least thirty (30) days prior to the event. We will use the information you provide only to arrange the accommodation and will make reasonable efforts to meet your request.
9. Health, Safety, and Assumption of Risk
You agree to follow all health and safety instructions from us, the venue, and public authorities. Attending an in-person Event involves inherent risks, including risks of illness, injury, and property loss. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU VOLUNTARILY ASSUME THESE RISKS, AND SMARTERX IS NOT RESPONSIBLE FOR LOSS, THEFT, OR DAMAGE TO YOUR PERSONAL PROPERTY OR FOR ANY INJURY OR ILLNESS, EXCEPT TO THE EXTENT CAUSED BY OUR NEGLIGENCE, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT. Nothing in these Event Terms limits liability that cannot lawfully be limited.
10. Virtual Events
Virtual Events are provided through third-party platforms, and Your use of those platforms may be subject to their terms. You are responsible for Your internet connection and equipment. Access credentials are personal to You and may not be shared. We are not responsible for technical interruptions outside our reasonable control, but if a material part of a virtual Event is unavailable due to a problem on our end, we will provide access to a recording if available or recorded.
11. Limitation of Liability; Disputes; Governing Law
Except as stated in Section 9, the disclaimers, limitation of liability, dispute resolution and arbitration, and governing law provisions of the Terms of Use (including Sections 14, 19, 20, and 21) apply to these Event Terms and to all Events. Our total liability for any claim relating to an Event will not exceed the amount You paid for that Event registration, except where applicable law does not permit this limitation. These Event Terms are governed by the laws of the State of Ohio, subject to any mandatory consumer protections of the place where You live.
12. Changes and Contact
We may update these Event Terms by posting a revised version with a new “Last Updated” date. The version in effect when You register governs Your registration, except for changes required by law or needed for health and safety.
